Twome Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Twome’s websites, apps, and services (the “Services”). The Services are provided by Vivid World Inc. d/b/a Twome (“Twome,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services
- Twome enables users to create AI-powered digital twins (“Twomes”) that can engage in live video calls and conversations, and to interact with Twomes created by others.
- We may add, change, or remove features at any time. We may suspend or terminate the Services or your access if necessary for security, legal, or operational reasons.
2. Eligibility
- You must be at least 16 years old to use the Services. If you are under the age required by your local law to consent to data processing or to enter a contract, you must have parental/guardian consent.
- You may use the Services only if you can form a binding contract with Twome and are not barred from doing so under applicable law.
3. Your Account
- Registration. You may need an account to use some features. Provide accurate information and keep it up to date.
- Security. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.
- One person, one account. Do not create accounts for others without their permission or misrepresent your identity.
4. Licenses and Ownership
- Your content. You retain ownership of content you create or upload, including images, videos, audio, prompts, messages, and metadata (“User Content”).
- License to Twome. To operate the Services, you grant Twome a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and perform your User Content, and to create derivative works as necessary to operate and improve the Services. This license includes processing for real-time calls, content delivery, moderation, and backups.
- Optional improvement license. We will only use your User Content (including conversation content) to train or improve models if you opt in.
- Biometric-related content. If you create a Twome of yourself, you grant us the rights necessary to analyze facial imagery and voice samples to generate and run your Twome, subject to your privacy choices and applicable law.
- Feedback. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without obligation to you.
5. Creating and Using Twomes
- You may create a Twome of yourself. Creating a Twome of another person requires their clear authorization. Do not impersonate others or mislead users.
- Visibility controls. You can set your Twome to public, link-only, followers, or private, and can block users or pause discoverability.
- Realistic media. Twomes may look and sound realistic. You must clearly label content where required by law and must not use Twomes to deceive, defraud, or harass.
- Recording consent. If you record calls or generate transcripts, you must comply with applicable consent laws (including all-party consent where required). Our product will display recording indicators, but you remain responsible for compliance in your jurisdiction.
6. Acceptable Use
You agree not to:
- Violate laws or rights of others, including privacy, publicity, IP, or biometric laws.
- Upload or generate content that is illegal, infringing, deceptive, defamatory, hateful, harassing, exploitative, or otherwise harmful.
- Create or use Twomes for impersonation, deepfake abuse, non-consensual sexual content, political misinformation, or medical/financial/legal advice that could cause harm.
- Attempt to re-identify or extract biometric templates, or probe the Services to obtain hidden system prompts, model parameters, or source code.
- Interfere with or disrupt the Services, circumvent security, rate limits, or access controls.
- Reverse engineer, decompile, or scrape the Services, except where permitted by law and then only after giving us prior notice.
- Use bots or automation to create accounts, farm referrals, or manipulate metrics.
- Collect or process children’s data or target under-16 users.
We may remove or restrict content or accounts that violate these Terms or our policies.
7. Content Moderation and Enforcement
- We may review, moderate, or disable User Content and suspend or terminate accounts to protect users and comply with law.
- We may preserve and disclose information if we believe it is reasonably necessary to comply with legal processes or to prevent harm.
- You can report violations in-app or via legal@twome.ai.
8. Intellectual Property
- Twome IP. The Services, including software, models, interfaces, visual design, and trademarks, are owned by Twome or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial use, subject to these Terms.
- Third-party rights. Some features rely on third-party services and open-source components which may be subject to their own terms.
9. AI Outputs and Disclaimers
- AI-generated content may be inaccurate, incomplete, or inappropriate. Verify critical information.
- Twome does not provide professional advice (medical, legal, financial, etc.). You use outputs at your own risk.
- You are responsible for how you use AI outputs and for complying with applicable law.
10. Payments and Subscriptions (If Offered)
- Some features may be paid. Prices, taxes, and billing terms will be shown at checkout or in-app.
- Subscriptions renew automatically until canceled. You can cancel at any time in your account settings; access continues until the end of the billing period.
- Refunds are governed by the terms presented at purchase and applicable consumer laws.
11. Third-Party Links and Services
- The Services may link to or integrate third-party sites or services. Twome is not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms.
12. Privacy
- Our Privacy Policy explains how we handle personal data, including biometric-related processing, recordings, and international transfers. By using the Services, you acknowledge that we will process your information as described in the Privacy Policy.
13. Termination
- You may stop using the Services at any time and may delete your account in-app (where available) or by contacting support.
- We may suspend or terminate your access immediately if you violate these Terms, pose a risk to others, or where required by law.
- Upon termination, licenses you granted for operating the Services continue as necessary to complete ongoing transactions, comply with law, and maintain backups for a limited period.
14. Warranties and Disclaimers
- The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
- Some jurisdictions do not allow disclaimers of certain warranties; in such cases, the above may not fully apply to you.
15. Limitation of Liability
To the maximum extent permitted by law:
- Twome and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Services.
- Our total liability for any claims arising out of or relating to the Services will not exceed the greater of: (a) the amounts you paid to Twome for the Services in the 12 months before the event giving rise to liability, or (b) USD $100.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Twome and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
(a) your User Content; (b) your use of the Services; (c) your violation of these Terms or applicable law; or (d) your infringement of any third-party right.
17. Updates to the Services and Terms
- We may modify the Services and these Terms from time to time. We will post updated Terms with a new “Last updated” date.
- If changes are material, we will provide additional notice (e.g., in-app notice or email). Your continued use after changes become effective constitutes acceptance.
18. International Use
- You are responsible for complying with local laws where you use the Services.
- You agree not to use the Services if you are subject to sanctions or on any U.S. government restricted lists, and not to export or re-export the Services in violation of export control laws.
19. Dispute Resolution; Governing Law
- Governing law. These Terms and any dispute will be governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws rules.
- Venue. Except where prohibited by law, any dispute will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction and venue.
- Injunctive relief. You agree that we may seek injunctive or other equitable relief to protect the Services and our IP.
Consumers in some jurisdictions may have mandatory rights to bring disputes in local courts; these Terms do not override such non-waivable rights.
20. Communications
- Service messages. We may send you transactional and service-related communications (e.g., security alerts, account notices).
- Marketing. You can opt out of marketing emails at any time via the unsubscribe link or by contacting us.

22. Miscellaneous
- Entire agreement. These Terms, plus any supplemental terms and policies referenced herein (including the Privacy Policy), are the entire agreement between you and Twome regarding the Services.
- Severability. If any provision is invalid or unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
- Headings. Headings are for convenience only and do not affect interpretation.
